These Terms of Use, along with our Privacy Policy, Mobile Devices Terms, and all policies posted on our website (collectively, the “Policies”), set forth the terms under which we provide access to and use of our website, services, applications, and tools (collectively, the “Services”).

By accessing or using Classified Med, you agree to comply with these Terms of Use and all incorporated Policies.

Company Information

Classified Med is operated by MobiMed Rentals LLC, a United States company.

Your Account

To access certain features of the Services, you may be required to create an account using your email address and password (“Account”).

You are responsible for:

  • Maintaining the confidentiality of your password

  • All activities that occur under your Account

  • Ensuring your information is accurate and up to date

You may not transfer your Account to another party without our written consent.

If you believe your Account has been compromised, please contact Classified Med Support immediately.

You may also connect to our Services using third-party login providers. By doing so, you authorize us to access, store, and use information from those services as described in our Privacy Policy.

Using the Services

You agree to post listings in the appropriate categories and not to:

  • Violate any applicable federal, state, or local laws in the United States

  • Post false, misleading, or fraudulent information

  • Infringe upon third-party rights

  • Post spam, chain letters, or pyramid schemes

  • Upload viruses or harmful technologies

  • Interfere with the proper operation of the website

  • Copy or distribute other users’ content without permission

  • Use bots, scrapers, or automated systems without written consent

  • Collect user information without consent

  • Bypass security or access restrictions

Abuse of Services

Please use our reporting tools to flag inappropriate listings or conduct.

We reserve the right to:

  • Remove content

  • Suspend or terminate accounts

  • Restrict access to the Services

  • Take legal or technical action when necessary

However, we are not responsible for monitoring all content and are not liable for unlawful or unauthorized user conduct.

Marketplace Nature of Platform

Classified Med is a marketplace platform. We do not own, inspect, or guarantee the quality, legality, safety, or condition of items listed.

Users are responsible for verifying equipment condition, compliance with medical regulations, and safe transactions.

Fees and Payments

Use of Classified Med is generally free. Certain features may require payment.

All fees:

  • Are listed in U.S. Dollars (USD)

  • Are non-refundable unless otherwise stated

  • May change at our discretion

If payment fails or fees are overdue, we may limit or suspend access.

Users are solely responsible for collecting and remitting any applicable U.S. sales tax or other taxes arising from their transactions.

Eligibility

To use Classified Med, you must:

  • Be at least 18 years old

  • Be legally capable of entering into binding contracts

  • Comply with all applicable U.S. laws and regulations

Content

The Services contain content from us, you, and other users.

By submitting content, you grant Classified Med a:

  • Non-exclusive

  • Worldwide

  • Perpetual

  • Irrevocable

  • Royalty-free

  • Sub-licensable license

to use, display, distribute, and promote your content in connection with the Services.

You agree not to copy, modify, or distribute our intellectual property without permission.

We reserve the right to remove content that violates these Terms or applicable laws.

Intellectual Property Infringement

Do not post content that infringes intellectual property rights, including copyrighted material, trademarks, or counterfeit items.

If you believe a listing infringes your rights, you may submit a written Notice of Claimed Infringement to Classified Med Support. We reserve the right to share such notices with the user who posted the content, as permitted by law.

Disclaimers

The Services are provided “as is” and “as available.”

We do not guarantee:

  • Accuracy of listings

  • Continuous or secure access

  • Quality or legality of items listed

To the maximum extent permitted by U.S. law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Classified Med and MobiMed Rentals LLC shall not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, goodwill, or reputation

If liability is established, our total liability shall not exceed the greater of:

  1. The total fees you paid to us in the previous 12 months, or

  2. $100 USD

Some states do not allow certain limitations, so these may not apply to you.

Indemnification

You agree to indemnify and hold harmless Classified Med, MobiMed Rentals LLC, and their affiliates, officers, employees, and agents from any claims, damages, or legal costs arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of any applicable law

Personal Information

By using the Services, you consent to the collection, storage, and processing of your personal information in accordance with our Privacy Policy. Data may be stored on servers located in the United States.

Reviews

Users may leave reviews consisting of star ratings and comments.

Reviews must:

  • Be truthful

  • Not harass or abuse

  • Not manipulate or mislead

Reviews cannot be edited or removed by users once submitted. We may remove reviews that violate our policies.

User reviews reflect the opinions of individual users and do not represent the views of Classified Med.

Governing Law

These Terms are governed by the laws of the United States and the State in which MobiMed Rentals LLC is registered, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located within that State.

Changes to Terms

We may update these Terms at any time. Updates become effective upon posting or upon your next use of the Services.

Continued use of the Services constitutes acceptance of the updated Terms.

Mobile Devices Terms

If you access Classified Med through a mobile application (“Application”), the following additional terms apply.

Application Use

You may not:

  • Modify or commercialize the Application

  • Rent or transfer rights

  • Reverse engineer or decompile

  • Remove proprietary notices

Use of the Application is at your own risk. We are not responsible for device damage or data loss.

Export Compliance

The Application may not be downloaded or exported in violation of U.S. export laws. You agree to comply with all applicable trade and export regulations.
