We do not own, manufacture, inspect, certify, control, or guarantee the medical or mobility equipment listed by users on our platform.

All listings are posted by third-party users. Classified Med does not verify the accuracy, condition, legality, safety, authenticity, or regulatory compliance of any item offered for sale or rent.

Users assume full responsibility for conducting their own due diligence before completing any transaction.

No Medical Advice

Information provided on Classified Med, including product descriptions, user communications, and listing content, is for informational purposes only and does not constitute medical advice.

Always consult a licensed healthcare professional before purchasing, renting, or using any medical or mobility equipment.

Use of any equipment listed on this platform is at your own risk.

Equipment Condition & Safety

Classified Med makes no warranties or representations regarding:

  • The operational condition of equipment

  • FDA compliance or regulatory status

  • Sterility or sanitation

  • Safety standards

  • Suitability for any particular medical condition

Buyers and renters are solely responsible for:

  • Inspecting equipment prior to use

  • Verifying safety and functionality

  • Ensuring compliance with applicable federal and state regulations

Transaction Responsibility

Classified Med is not a party to transactions between buyers and sellers.

We do not:

  • Guarantee payments

  • Provide escrow services (unless otherwise stated)

  • Guarantee delivery

  • Resolve disputes between users

All agreements, payments, deliveries, returns, and warranties are solely between users.

Limitation of Liability

To the fullest extent permitted under U.S. law:

Classified Med and MobiMed Rentals LLC shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Personal injury

  • Medical complications

  • Property damage

  • Loss of profits

  • Loss of data

  • Loss of business

  • Equipment malfunction

  • Death or serious bodily harm

arising out of or related to:

  • Use or misuse of equipment

  • Reliance on listing information

  • User communications

  • Delayed, defective, or unsafe products

  • Transactions between users

If liability is found to exist, the maximum aggregate liability of Classified Med and MobiMed Rentals LLC shall not exceed $100 USD.

User Assumption of Risk

By using Classified Med, you acknowledge and agree that:

  • Medical and mobility equipment carries inherent risks

  • You voluntarily assume all risks associated with purchasing, renting, selling, or using such equipment

  • You release Classified Med and MobiMed Rentals LLC from any claims arising from such risks

Indemnification

You agree to indemnify, defend, and hold harmless Classified Med, MobiMed Rentals LLC, its owners, officers, employees, affiliates, and agents from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of:

  • Your use of the platform

  • Your listings

  • Your violation of laws or regulations

  • Any injury or damage caused by equipment you sell, rent, or purchase

No Warranty

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or reliability

We do not guarantee uninterrupted or error-free service.

Medical Equipment Compliance & Risk Protection 

FDA & Regulatory Compliance

Users acknowledge that certain medical and mobility equipment may be regulated under United States federal and state laws, including but not limited to regulations enforced by the U.S. Food and Drug Administration (FDA).

By listing, selling, or renting any item on Classified Med, you represent and warrant that:

  • You have the legal right to sell or rent the item

  • The item complies with all applicable federal, state, and local laws

  • The item is not stolen, recalled, counterfeit, or restricted

  • You are not violating any prescription or licensing requirements

  • You are not distributing regulated medical devices without proper authorization

Classified Med does not verify regulatory compliance and assumes no responsibility for any regulatory violations committed by users.

Prohibited Medical Devices & Restricted Items

The following items are strictly prohibited from being listed unless explicitly permitted under applicable law:

  • Prescription-only medical devices without proper authorization

  • Oxygen tanks or compressed medical gases

  • CPAP or BiPAP machines requiring prescription (unless legally transferred in compliance with law)

  • Implantable medical devices

  • Controlled medical substances

  • Recalled or defective medical equipment

  • Counterfeit or unauthorized branded medical products

  • Any device requiring licensed medical supervision for transfer

We reserve the right to remove any listing at our sole discretion.

Repeated violations may result in account suspension or permanent removal.

Seller Certification

By posting a listing on Classified Med, you certify that:

  • The equipment is accurately described

  • You disclose all known defects

  • The equipment is clean and safe for intended use

  • You comply with all sanitation and safety standards

  • You understand that medical devices may carry liability risk

You accept full legal responsibility for any injury, damage, or loss caused by equipment you list.

Buyer & Renter Responsibility

Buyers and renters agree that:

  • They will inspect equipment before use

  • They will verify compatibility with medical needs

  • They will consult a licensed healthcare provider when necessary

  • They assume full responsibility for proper setup and usage

Classified Med does not provide medical guidance, setup assistance, or operational certification.

Assumption of High-Risk Use

Certain medical and mobility equipment may pose risk of serious injury, illness, or death if improperly used.

By engaging in transactions on Classified Med, you acknowledge and accept all inherent risks associated with medical equipment use.

You voluntarily waive any claim against Classified Med and MobiMed Rentals LLC arising from such risks.

Florida-Specific Governing Law (If You Want It Stronger)

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising from use of Classified Med shall be brought exclusively in the state or federal courts located in Florida.

Users consent to personal jurisdiction in those courts.

No Agency Relationship

Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between Classified Med and any user.

Users act independently and at their own risk.

Platform Immunity Notice

Classified Med functions solely as an online intermediary platform.

To the maximum extent permitted under Section 230 of the Communications Decency Act (47 U.S.C. § 230), Classified Med is not liable for user-generated content or third-party transactions.

Marketplace Rental Disclaimer

No Rental Provider Relationship

Classified Med (classifiedmed.com), operated by MobiMed Rentals LLC, is solely an online marketplace that allows users to advertise medical and mobility equipment for rent.

Classified Med:

  • Is NOT the owner of listed equipment

  • Is NOT the rental provider

  • Is NOT a party to any rental agreement

  • Does NOT collect rental payments (unless explicitly stated)

  • Does NOT negotiate rental terms

  • Does NOT supervise equipment use

All rental agreements are made directly between the equipment owner (“Lessor”) and the renter (“Lessee”).

Independent Transactions

Any rental transaction initiated through Classified Med is strictly between users.

Classified Med does not:

  • Draft rental contracts

  • Enforce rental agreements

  • Guarantee payment

  • Guarantee delivery or condition of equipment

  • Resolve disputes between parties

Users are solely responsible for creating their own legally binding rental agreements.

No Agency or Partnership

Nothing on Classified Med creates:

  • An agency relationship

  • A partnership

  • A joint venture

  • An employment relationship

Equipment owners act independently and are not representatives of Classified Med or MobiMed Rentals LLC.

Rental Risk Acknowledgment

Medical and mobility equipment may involve safety risks.

By using Classified Med to arrange a rental, you acknowledge that:

  • You assume all risks related to equipment use

  • You are responsible for verifying safety and condition

  • You release Classified Med from any liability arising from rental transactions

Classified Med is not a rental company, broker, or escrow service. We provide advertising space only.
